Bombay High Court dismisses copyright plea against 'Dream Girl 2', Petitioner fined ₹10 Lakh

The Bombay High Court on Wednesday dismissed the petition filed against Ayushmann Khurrana's film 'Dream Girl 2'. This petition was filed by writer Asim Bagchi, in which he alleged copyright infringement by calling the story of the film a copy of his script written in 2007. 

According to PTI, Justice R.I. Chhagla, while giving the verdict, said that just having a similar plot or character does not constitute a case of copyright infringement. The court clarified that there is no solid basis for copyright infringement in Asim Bagchi's petition.

In this case, the court gave a big blow to the petitioner and ordered him to pay 2 lakh rupees each i.e. a total of 10 lakh rupees to Ekta Kapoor's company Balaji Telefilms, the writer, director of the film and five other people. In the judgment, Justice Chagla also cited the 1993 Hollywood film ‘Mrs. Doubtfire’, which also featured a male character dressed as a woman – just like in ‘Dream Girl 2’. This makes it clear that such characters have been shown in cinema before and this is not a new or original concept.

It is worth noting that even in 2023, the demand to stop the release of the film was rejected by the court, because the petition was filed at the last moment. Now the court has clearly stated that there is a lot of difference between Bagchi’s story and ‘Dream Girl 2’, and this matter does not come under the purview of copyright.
